1. Introduction  

Welcome to Open On Sundays Design (openonsundaysdesign.com). These Terms and Conditions outline the rules and regulations for using our website and services. By accessing this website and engaging in our services, you agree to comply with these terms.  

2. Services Provided  

Open On Sundays Design offers web design and branding services. Our services are available to anyone, regardless of industry or location.  

3. User Responsibilities  

By using our website, you agree to:  
- Not engage in spam or any form of unauthorized use of content.  
- Not resell or redistribute any of our services, designs, or materials.  

4. Payments and Refunds  

Payments are processed through Honeybook. A 50 percent deposit is required to begin a project. This deposit is non-refundable. Refunds are offered at the discretion of the designer on a case-by-case basis. If a project is abandoned for more than two months with no communication, all fees paid are non-refundable.  

5. Service Delivery and Timelines  

We guarantee specific delivery timelines for projects. However, timely delivery depends on the client providing necessary materials and feedback. If a client fails to provide required materials on time, the project schedule may need to be moved, and the client may be required to pay a restart fee. This is determined on a case-by-case basis.  

6. Intellectual Property  

All content on this website, including designs and branding, is owned by Open On Sundays Design. Clients own the final design work created for them, but they may not modify or resell the designs.  

7. Liability and Disclaimers  

Open On Sundays Design does not offer guarantees on services. We are not liable for any issues arising from our designs, including but not limited to website downtime, lost revenue, or third-party platform issues. We do not disclaim responsibility for third-party tools or integrations we recommend.  

8. Termination of Services  

We reserve the right to refuse service or terminate a client agreement under the following conditions:  
- Non-payment  
- Non-communication or non-responsiveness  
- Abusive behavior, including written, emotional, threats, or rudeness  

We also reserve the right to suspend or ban users from our website.  

9. Dispute Resolution  

Disputes will be handled through mediation or legal action. These terms are governed by the laws of the state of Florida, United States.  

10. Changes to Terms  

We may update these Terms and Conditions from time to time. Any changes will be posted on our website.
